These Terms of Service (“Terms”) govern your access to and use of the SyncNomads community platform at syncnomads.digital (“Platform”), operated by Digitech Nomads Private Limited (“Company”, “we”, “us”), a company incorporated under the laws of India, with its registered office in Greater Noida (West), Gautam Buddha Nagar, Uttar Pradesh, India.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years of age to create an account. By registering, you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at ictadmin@digitechnomads.com if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms or our Community Guidelines.

3. Acceptable Use

When using SyncNomads, you agree to:

  • Comply with all applicable Indian laws and regulations
  • Follow the Community Guidelines posted at /guidelines
  • Respect the intellectual property rights of others
  • Not use the Platform for unsolicited commercial solicitation or spam
  • Not attempt to gain unauthorised access to any part of the Platform
  • Not upload malicious code, viruses, or any harmful material
  • Not impersonate other users or misrepresent your identity or affiliation

4. Content You Post

Ownership. You retain ownership of the content you post on SyncNomads.

Licence. By posting content, you grant Digitech Nomads Private Limited a non-exclusive, worldwide, royalty-free licence to host, display, distribute, and make your content available to other users of the Platform. This licence exists solely to operate and improve the Platform.

Responsibility. You are solely responsible for the content you post. We do not pre-screen content but reserve the right to remove any content that violates these Terms or Community Guidelines.

Prohibited Content. You may not post content that is defamatory, obscene, threatening, harassing, hateful, or that infringes on any third party’s intellectual property or privacy rights.

5. Intellectual Property

The SyncNomads name, logo, brand assets, and platform design are the property of Digitech Nomads Private Limited. You may not use our trademarks without prior written permission.

The Platform runs on Discourse, open-source software licensed under the GNU General Public License v2.0.

6. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

7. Third-Party Services

The Platform integrates with third-party services for email delivery (Plunk/Amazon SES) and file storage (Amazon Web Services S3). Your use of these services through the Platform is subject to their respective terms and privacy policies.

8. Availability and Modifications

We strive to keep the Platform available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any aspect of the Platform at any time without prior notice.

We reserve the right to update these Terms. Material changes will be communicated via a Platform announcement. Continued use after changes constitutes acceptance of the revised Terms.

9. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Digitech Nomads Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.

Our total liability for any claim arising from these Terms shall not exceed INR 5,000 (Indian Rupees Five Thousand).

11. Indemnification

You agree to indemnify and hold harmless Digitech Nomads Private Limited, its directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Greater Noida (West), Gautam Buddha Nagar, Uttar Pradesh, India.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
